Is it justified for Pak army to kill fellow Muslims?

I'm serving as an army officer in North Waziristan and currently I'm on leave and my leave is for the shorter duration. Can u justify who is called shaheed either, we the soldiers or the miscreants whom we kill, because they are also calling themselves shaheed? Who is right as per the Islamic point of view? Are we doing Jihad or the miscreants? What about the civilians who are innocent and during the process of killing miscreants they also come under fire which is never the intention of the army? Will we be having that sin on our shoulders of killing civilians unintentionally? Is it right for me to kill the Muslims in Waziristan?

If you as a soldier of Pakistan Army and are convinced that the battle in Waziristan is a just one and that Muslims on the other side of the divide are creating unnecessary mischief, you have to engage in the battle and in the process, unfortunately, you will kill fellow Muslims. However, if you have doubt if the cause you are fighting for is not just and there was no cause for you kill fellow Muslims, your fighting against them is haram.
Likewise is true for the other side. If they believe that Muslims are being unjustifiably killed by Pak Army and they are toeing the line of the enemies, their fight could be termed as justified.
In other words, it all depends on how you look at the situation.
My personal understanding is that the other side is not justified in fighting against Pakistan Army, even if their allegation that Pakistan is fighting for US interests is correct. Muslims should not fight against a Muslim state under any circumstances. However, Pakistan Army also doesn’t have a right to fight against fellow Muslims unless the other side have been properly given a chance to understand that what they are doing is wrong. I think the impression that Pakistan is toeing the US agenda is what is causing problems. You should also decide what you think is the truth about it: If you sincerely believe that had it not been because of US pressurizing, Pak Army wouldn’t have been fighting their fellow Muslims, you shouldn’t be fighting Muslims in Waziristan. As I said, you should decide it in accordance with your conscience. Even if you are in doubt, you should not fight fellow Muslims.
